1. Purpose
These General Terms and Conditions of Sale (T&C) govern the sale of digital guides, personalized travel and cruise planning services offered by MonTataneTour, a company specializing in travel and cruises. These T&C apply to any order placed by a user via our website.

3. Products and Services Offered
MonTataneTour offers the following products and services:
- Digital Guides (PDF): Detailed guides on cruise stops in specific destinations, primarily in the Mediterranean, Caribbean, and other international destinations. These guides are exclusively intended for cruise travelers, helping them maximize their stop by providing practical and personalized information.
- Customized Travel Programs: Creation of tailor-made itineraries for cruise stops, based on the client’s specific needs and preferences. This service includes recommendations tailored to each port of call (except embarkation and disembarkation ports), considering local characteristics and the traveler’s interests.
Payment and Modification Conditions:
- Non-refundable. Once payment is made for a customized program, no refunds will be given. Once the payment is received, MonTataneTour immediately starts working on creating and personalizing the program. Since the program is a tailor-made service, it cannot be refunded once it has been started, finalized, and sent. This condition also applies to digital products such as ebooks, once downloaded or sent.
- Program Validation and Client Commitment. Before proceeding with the payment, we ask clients to correctly complete the contact form on our website. This form includes essential information such as their goals (beaches, sightseeing, etc.), their budget for activities during the cruise, and their preferences. Once the program is validated and payment is made, you accept the following rules: the program is final and fixed. It can no longer be modified or adjusted, as MonTataneTour is a small structure and each program takes several days to prepare.
- Limitation of Modifications. After the program is validated and payment is received, the client can no longer request modifications due to the complexity and time involved in creating the customized program. Each program takes about 3 to 4 days of work, and this process is finalized with the delivery of the program. Other clients, as well as the client who purchased the program, require our services within the agreed timeframes.
Limitations and Responsibilities:
- Client’s Personal Responsibility. The client is responsible for adhering to schedules, instructions provided, and ensuring their safety during suggested activities or excursions. MonTataneTour cannot be held responsible for delays or consequences resulting from the client’s personal actions or decisions (such as not showing up for an excursion on time, forgetfulness, inappropriate behavior, etc.).
- Prices and Information Subject to Change. While MonTataneTour strives to provide accurate information, prices and conditions for excursions, transportation, or other services may change due to unforeseen circumstances such as construction, strikes, or changes to local services. Similarly, information provided about schedules or itineraries may be subject to variations beyond MonTataneTour’s control.
- Force Majeure. MonTataneTour will not be held responsible for delays, cancellations, or changes to itineraries or activities related to unforeseen events such as extreme weather conditions, administrative closures, strikes, or any other event beyond our control.
- Limitation of Financial Liability:
As far as the law permits, MonTataneTour will not refund the client for any reason, including but not limited to excursions, activities, or services that are non-compliant, delayed, or modified. MonTataneTour’s liability is strictly excluded in the event of moral, financial, or any other form of direct or indirect loss related to the provision of services. Once the program is validated and paid for, no refund or compensation requests will be accepted. - No Guarantee of Total Satisfaction. Although MonTataneTour strives to provide quality services and accurate information, it is understood that total satisfaction cannot be guaranteed 100%. Differences in expectations, preferences, or impressions may arise, and MonTataneTour cannot be held responsible for such disagreements.
- Non-transferability of the Program. Programs and itineraries created for the client are personal and non-transferable. In case of participant changes, MonTataneTour must be informed in advance and reserves the right to adjust the program or refuse the change.
- Protection of Personal Data. MonTataneTour respects the confidentiality of personal information collected and is committed to not sharing it without prior consent, unless required by law. Data is processed in accordance with the current regulations (e.g., GDPR in Europe).
- Dispute Resolution. In case of a dispute, the client and MonTataneTour agree to prioritize an amicable resolution. If no amicable solution is found, any conflict will be submitted to the competent courts of the country where MonTataneTour is registered, according to the applicable legislation.
4. Pricing
- Digital Guides – The price of the guides is 9.90 €.
- Personalized Programs – The price is set at 149.90 € per personalized program.
The prices of products and services are stated in euros (€) and are excluding VAT (excl.). As a self-employed person under the VAT exemption scheme, VAT does not apply to these products. Therefore, no VAT will be charged on these products and services.
5. Payment Methods
Payments are made exclusively by credit card (CB) or via PayPal. Transactions are secured and validated by a third-party payment processor, ensuring the confidentiality and protection of your banking information.
- For the Digital Guide (PDF) – Once the payment is confirmed, the client will immediately receive a link to download the guide.
- For Personalized Itineraries – After payment is received, the client will receive their personalized program by email within a maximum of 7 working days, due to the customized nature of the service.
6. Download of Digital Products
After payment is received, the digital guide (PDF) will be available for immediate download. It is understood that digital products are non-physical goods, and the download triggers the execution of the contract.
7. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, you have a period of 14 days to exercise your right of withdrawal and cancel your order, starting from the receipt of the digital product.
However, once the guide has been downloaded, the right of withdrawal is lost. As a digital product, once it is downloaded, it is considered fully delivered and you cannot request a refund, in accordance with Article L221-28 of the French Consumer Code.
This means that once you have downloaded the guide (PDF), it is no longer possible to request a refund, even if you finish reading the guide in just a few hours.
8. Delivery of Digital Products
Digital products (PDF guides) will be available to the client immediately after payment confirmation. The client will receive a download link to the email address provided during the purchase.

9. Personalized Services (Travel Programs)
The personalized program service is a one-time service, where MonTataneTour designs a custom travel itinerary. Once paid, the client will receive their personalized program by email within a maximum of 7 working days.
Due to the personalized nature of this service, the program is neither exchangeable nor refundable after receipt, except in cases of force majeure or clear error on our part.
10. Responsibilities and Guarantees
MonTataneTour uses all necessary means to provide reliable and useful information. However, we cannot guarantee the complete accuracy of the information provided, as it may change (cruise schedules, itineraries, etc.). The client is advised to verify details with third-party operators or providers before booking or taking actions based on our guides.
We disclaim any liability in the event of changes beyond our control (cruise delays, schedule changes, etc.).
11. Intellectual Property and Exclusivity of the Guides
The digital guides sold by MonTataneTour are written by passionate cruisers, not by robots or automatically generated. All information contained in these guides is our own findings, gathered through our real-life experiences during our cruises. MonTataneTour creates exclusive guides based on personal observations, with special attention to the needs of cruisers.
We take pride in offering quality, reliable, and up-to-date information. You will not find guides like these, specially designed by and for cruisers, anywhere else. MonTataneTour guides are exclusively sold on our official website: www.montatanetour.com, ensuring their authenticity and exclusivity.
